A new regulation from the Ministry of Environment and Energy covers the installation of solar panels on apartment buildings.

Solar panels on apartment building rooftops: Everything you need to know about the new changes
According to the provision included in Article 70 of the Ministry of Environment and Energy’s bill entitled  “Modernization of the framework for water supply and wastewater services and urgent energy and planning regulations,” which is currently under consultation, for installing solar panels and batteries in apartment buildings and shared areas:

  • consent from 51% of the owners is sufficient, and the requirement for consent from 100% of the co-owners stipulated in the original decision is waived.
  • up to 40% of the total shared area may be occupied.

“In shared areas of buildings comprising more than one separately owned property, where the installation of photovoltaic systems and storage systems is permitted under planning legislation, decisions by the General Assemblies of co-owners to install these systems on an area of up to forty percent (40%) of the total shared area are adopted by an absolute majority of fifty-one percent (51%), corresponding to the co-ownership shares. Any related decision on implementing and regulating the above decisions is adopted by the same majority,” the bill’s article states.

“This provision does not apply to properties covered by the Code of Legislation on the protection of antiquities and cultural heritage in general (Law 4858/2021, A΄ 220)” is added to the bill.

The process

Once the other co-owners have also agreed to installing solar panels on the apartment building, the interested party will need to take the following steps. Specifically:

  • They will be able to purchase the necessary equipment
  • They will be able to submit an application to ΔΕΔΔΗΕ for the connection terms,
  • They will apply to the Building Authority for approval to carry out small-scale works,
  • They will coordinate with ΔΕΗ to sign the final 25-year contract. This will set out the agreement under which electricity will be fed into the grid, and the process will be completed once the connection is made.

It is clarified that solar panels or energy storage systems cannot be installed on the stairwell overrun, in the elevator shaft, or on top of another structure. It is also noted that solar panels must be installed  within the boundaries of the roof and be 50 centimeters from its perimeter, while if the roof is flat (a roof terrace),  this  distance must be 1 meter.
